By using the TCH Guest Wireless Network (“Service”), you accept and agree to the following terms:

You hereby acknowledge and agree that in your use, you will not:

• Engage in activity that is (i) in violation any applicable law, rule, regulation, or ordinance or (ii) harmful, threatening, abusive, harassing, tortious, offensive, obscene, defamatory, invasive of another's privacy, hateful, fraudulent, or otherwise objectionable;
• Circumvent, disable, or otherwise interfere with security-related features of the Service; and
• Engage in activity that may interrupt, destroy, interfere with, or limit the functionality of the Service.

You expressly acknowledge and agree that (i) your use is at your sole risk and the service is provided on an “as is” and “as available” basis; (ii) The Clearing House Payments Company L.L.C. and its affiliates, officers, employees, and agents (collectively “TCH”) expressly disclaim (a) any and all liability of any kind and (b) any and all warranties of any kind whether express or implied, and make no representations or warranties of any kind that the service will meet your requirements or expectations, be secure, free of malware, or other harmful components.

You expressly acknowledge and agree that TCH (i) may monitor and analyze network traffic on the TCH Guest Wireless Network for any legitimate purpose including monitoring for harmful, malicious, and/or illegal activity, and (ii) may suspend or prevent your access and use of the TCH Guest Wireless Network for any reason.

Without limiting the generality of the forgoing, you expressly acknowledge and agree that in no event shall TCH be liable to you or any third party for any direct, indirect, special, consequential, or exemplary damages.
