Q and A
Q.)  I am being told by a co-worker that our company must email notice to our customer(s) 10 days before a recurring ACH debit is scheduled to post. We don’t mail bills to our auto pay customers and we don’t have email addresses for all of them, so I need to know if this is an Originator requirement in the ACH Rules.
A.)  Article Two, Subsection 2.3.2.6 of the NACHA Rules outlines notice requirements for variable debits to consumer accounts (Page OR7, 2019 ACH Rules). Generally speaking, when there is a change to the debit amount, the Originator must send the Receiver written notification at least 10 calendar days prior to debit date. When there is a change to the date, the Originator must send notification at least 7 calendar days before the scheduled debit. For recurring debits, when the amount or date don’t change, the ACH Rules do not require notice if the intent to debit is clearly explained during the authorization process.
