Q.)  Do we mitigate ODFI liability if we require an Originator to prefund an ACH credit file?
A.)  Yes, pre-funding (which is not addressed within the ACH Rules) will lessen your exposure but does not eliminate the ACH Rule requirement for establishing, implementing, and conducting a periodic review of exposure limits for every Originator and Third-Party Sender. Although pre-funding is optional, in some cases it is considered a best practice. To limit your liability, it’s important to ensure that the offsetting (funding) dollars are ‘good’.
