Q.)   Is a DocuSign signature considered similarly authenticated? Can we use it to collect authorizations for ACH debits and signatures for Written Statement of Unauthorized Debit (WSUD) forms?
A.)   According to the Nacha Operating Rules (page OR7, SUBSECTION 2.3.2.5, Electronic Authorizations), signature requirements may be satisfied by compliance with the E-Sign Act but neither Nacha or the Act speak to specific signature products. There are numerous solutions on the market and ultimately individual organizations must determine which comply with E-Sign and meet the standard of being commercially reasonable. That said, the DocuSign website states that their electronic signature product complies with the definition of an electronic signature under E-Sign.

ACH Contact Registry Reminder

Nacha’s new ACH Contact Registry was created for financial institutions (FIs) to be able to more easily connect with other FIs about ACH operations, exceptions and risk management. Beginning July 1, 2020 all FIs participating in the ACH Network will be required to register contact information for personnel or departments responsible for ACH operations and fraud/risk management.
