The writing and signature requirements contained in the Nacha Operating Rules can be satisfied by compliance with the Electronic Signatures and Global National Commerce Act (e-Sign Act). To satisfy the Nacha Rules (and Regulation E for preauthorized debits), electronic signatures must “similarly authenticate” the electronic records (i.e. agreements, authorizations and WSUDs). The authentication method chosen must evidence both the signer’s identity and his/her assent to the terms of the record. We’ll discuss sound business practices for satisfying the requirements of the related rules and regulations.
